“Emotionless” vs “Just”: AI in Courts
Emotion can bias. But removing emotion does not automatically yield justice. Justice is a procedure with constraints we can test.
Three pillars
- Due process by design: Timelines, evidence rules, disclosure, right to be heard—encoded and enforced.
- Audit trail: Every step logged; reasons linked to statute and precedent; decisions reproducible.
- Public oversight: Anonymized datasets and metrics published; appeal paths clear and accessible.
With these, an AI judge could be audited. Without them, “emotionless” risks being fast, consistent—and wrong.
